What if I don’t know where my spouse lives?
If you and your spouse have been separated for years and you don’t know their current address, you can still file for divorce using this packet. However, you may also need to complete a publication packet so the court can notify your spouse through legal notice. If this applies to you, contact us before filing so we can make sure you have the right set of documents.
Do I have to go to court?
Yes. Even in an uncontested divorce, Oklahoma law requires at least one spouse to appear before a judge. In the case where you don’t know where your spouse is, you may have to appear before the Judge twice. Once to request to publish the divorce in a newspaper and the second time to get your divorce finalized. Both times, the judge will review your paperwork and ask a few simple questions before signing the documents.
What costs are not included?
Court filing fees (around $275), notary fees, and process server costs are not included in this packet. If your spouse’s whereabouts are unknown, you may also need to serve them by publication.
