If the other legal parent is deceased, the court will require proof of death before approving a minor child’s name change.

  • A certified death certificate (most commonly accepted)

  • A copy of a published obituary

  • Other official documentation confirming the death

In almost all courts in Oklahoma, yes, your child is required to appear in person.  If there is a valid reason that your child cannot appear you can request that your child’s appearance be waived but only the judge can give you that permission.  Speak with the judge’s bailiff in advance of your hearing about this if it is an issue for you.
