Will the court accept these forms?
Every judge has discretion, but this packet follows Oklahoma statutes and local formatting standards. Everyone who has used my forms have done so successfully. If you encounter a judge who wants something changed, reach out to me and I will assist you with the requested changes.
What if I don’t know where my spouse lives?
If you and your spouse have been separated for years and you don’t know their current address, you can still file for divorce using this packet. However, you may also need to complete a publication packet so the court can notify your spouse through legal notice. If this applies to you, contact us before filing so we can make sure you have the right set of documents.
Do I have to go to court?
Yes. Even in an uncontested divorce, Oklahoma law requires at least one spouse to appear before a judge. In the case where you don’t know where your spouse is, you may have to appear before the Judge twice. Once to request to publish the divorce in a newspaper and the second time to get your divorce finalized. Both times, the judge will review your paperwork and ask a few simple questions before signing the documents.
What costs are not included?
Court filing fees (around $275), notary fees, and process server costs are not included in this packet. If your spouse’s whereabouts are unknown, you may also need to serve them by publication. In that case, you’ll need a Publication Packet (sold separately for $100). This packet is paralegal-created, very specific, and tailored to meet Oklahoma court requirements. You’ll also pay the newspaper directly to publish the notice — usually $80–$100 depending on the publication.

How long does the divorce process take?
From the date you file the petition, you must wait a minimum of 10 days before a judge can sign your decree. The actual amount of time depends on when the judge has time available to set your case and how long it take for your spouse to sign the documents and return them to you.
